Highmark Update | Notice of loss rebate
The Affordable Care Act (ACA) includes a Medical Loss Ratio (MLR) requirement for health insurers. The MLR provision mandates that insurers rebate all or a portion of the premiums paid if a certain percentage of premiums collected are not spent on claims or quality improvement programs. Read more.
In late February 2023, the IRS, DOL and HHS issued a joint announcement detailing how group health plans are to comply with the gag clause attestation requirements, or Gag Clause Prohibition Compliance Attestations (GCPCA), established by the Consolidated Appropriations Act, 2021. Employer sponsored group health plans (both self-funded and fully insured) are prohibited from entering into agreements with a health care provider, network or association of providers, Third Party Administrator, or other service provider where the plan is restricted from accessing and sharing certain information. Geisinger | Updates for the Gag Clause
As part of the Consolidated Appropriation Act of 2021, insurance companies and employerbased health plans are required to annually submit a gag clause prohibition compliance attestation (GCPCA) to the Departments of Health and Human Services, Labor and Treasury. Read more.
