NAHU Update: Health Reform Subsidy Ruling May Have Profound Long-Term Impact But Causes No Immediate Market Change

The U.S. Court of Appeals for the D.C. Circuit released a 2-1 decision today in the Halbig v. Burwell case determining that the IRS and the federally facilitated exchange marketplace was not authorized to distribute premium tax credit subsidies to individual exchange consumers. The court determined that the Patient Protection and Affordable Care Act (PPACA) unambiguously restricts the availability of subsidies to insurance purchased in state-based exchanges, and that the IRS regulation acted outside of the parameters of the PPACA by making available subsides via the federally facilitated and partnership exchanges. Producers who have completed the training and registration process to sell on the Marketplace should email copies of their certificates and their FFM User ID to cbcproducerlicensing@capbluecross.com or fax them to 717-540-2282. Producers who need to complete the training and registration can reference the Producers in the Federally Funded Marketplace attachment.

Blue Cross Northeastern PA

Producers who have completed the FFM certification will receive a “Certificate of Completion.” E-mail a copy of that certificate and the National Producer Number (NPN) that was used to register with CMS to Broker.Submission@bcnepa.com and Kerri.McKeown@bcnepa.com.

Investigators obtain ObamaCare coverage, subsidies using fake identities

Undercover government investigators were able to obtain thousands of dollars in taxpayer subsidies under ObamaCare using fake identities, according to findings presented to Congress on Wednesday. The probe by the Government Accountability Office has raised fresh concerns about the ability of the sprawling health care program to prevent or intercept costly fraud schemes.
